Terms and Conditions

No changes to, waiver of, or addition to any of these terms and conditions shall be effective unless agreed to in writing and signed by Atlanta Rubber & Hydraulics, Inc.

The buyer acknowledges and agrees that these terms and conditions supersede the terms and conditions of any purchase order or other documentation used by Buyer and, except for delivery and billing addresses, and quantities prices and items ordered, any conflicting or additional terms are void and have no effect, but that Buyer may place orders by use of purchase orders and other documentation for its convenience purposes only.

All of the following terms and policies are the sole discretion of Atlanta Rubber & Hydraulics, Inc.

Returns Policy

All approved returns must be returned within 30 days of delivery, have been purchased from Atlanta Rubber & Hydraulics, return in resale condition, and or as originally described.  NO RETURNS OF ANY HOSE OR HOSE ASSEMBLY WILL BE ACCEPTED.  All return freight charges will be the sole responsibility of the purchaser.  Cash customers may return unused goods for credit, however packing, delivery, handling, and restocking fees will be deducted from the credit.  All approved returns will be subject to a 20% restocking fee.

Warranty

We warrant all products to be free from defects in material and workmanship under normal operating conditions.

Shipping

We can ship to virtually any address in the world. Note that there are restrictions on some products, and some products cannot be shipped to international destinations.

When you place an order, we will estimate shipping and delivery dates for you based on the availability of your items and the shipping options you choose. Depending on the shipping provider you choose, shipping date estimates may appear on the shipping quotes page.

Please also note that the shipping rates for many items we sell are weight-based. The weight of any such item can be found on its detail page. To reflect the policies of the shipping companies we use, all weights will be rounded up to the next full pound.

Limitation of Liability

In no event shall Atlanta Rubber & Hydraulics, Inc. be liable for consequential damages, included but not limited to loss of use, data, business or income, damage to associated equipment, cost of substitute goods, facilities or services, downtime costs or claims of Buyer’s customers for such damages and will not be considered reasonable grounds for nonpayment.

Payment Terms

Are net 30 days from invoice date and may be subject to credit approval.  Any alleged discrepancies between the goods ordered and those supplied and invoiced must be advised, in writing to the seller within ten days of receipt by the customer.  Down payments may be required and will be determined by our credit department.

Line of Credit

We are pleased to offer a line of credit to be used at Atlanta Rubber & Hydraulics to those who qualify.  A credit application must be submitted to our credit department for consideration and approval.  A credit hold may be placed on the account for any reason and may only be removed by our credit department.

Past Due Accounts

Past due accounts with balances over 45 days will be placed on CREDIT HOLD until the account is current.  All cash balance invoices will be charged a late fee of $15.00 and all credit invoices will be charged an interest rate of 10% annually.  Should the account exceed the stated payment terms the buyer shall pay all collections, court, and or attorney’s fees associated with recovering the past due balance.  There will be no notification by Atlanta Rubber & Hydraulics, Inc. that an account has exceeded the time periods set forth above and it shall be the sole responsibility of the customer to adhere to Atlanta Rubber & Hydraulics, Inc. terms and conditions.

Force Majeure

Seller shall not be liable for any failure to perform any of seller’s obligations where such failure shall include, without limitations, acts of God, accidents, fire, flood, failures in delivery of carriers or suppliers, shortages of materials, war, acts of foreign enemies, labor disputes, strike, and any other cause beyond sellers control.

Taxes

In addition to any prices, Buyer shall pay the amount of any present or future manufacturer’s tax, retailer’s occupation tax, use tax, sales tax, excise tax, duty, custom, inspection or testing fee, or any other tax, fee or charge of any nature whatsoever imposed by any governmental authority, on or measured by the transaction between Seller and Buyer.  In the event Seller is required to pay any such tax, fee or charge, the buyer will be invoiced accordingly.
